EOHR condemns the torture of the Muslim Brotherhood convicts
and calls for an immediate investigation
14/6/2004
EOHR expresses its vehement anxiety concerning information received about torturing seven of the convicts in the case no.462/2004(National Security Higher Court), also known as " Muslim Brotherhood case".
EOHR reported today to the Prosecutor General about this torture incident. The families of the convicts received information that the convicts were transported to National Security Investigations building in Nasr City. Consequently, lawyer of EOHR headed to Nasr City to attend the investigations.
While the convicts were in the presence of the Prosecutor General of the National Security Court, they stated that they were informed that they are required to complete the investigations and they were transported from the Tora prison to "Estiqbal" (Reception) prison. They waited there for four hours then they were taken to the National Security Investigations building in Nasr City.
Torture was used in the following methods:
1) They were handcuffed backward and were also eye-folded.
.
2) They were stripped naked and stayed in this humiliating situation from the 3rd of June till the 10th of June 2004.
3) The convicts stated also that they stayed handcuffed for the whole detention period, and they were deprived from vital needs like sleeping and using restrooms.
4) Torture using electric shocks used in the following methods:
- Connecting electric poles to the toes and the head, which allows the electric current to form a full circuit.
- Connecting electric poles to the genital organs and the nipples.
5) Suspending the victims from a metal duct with their arms tied.
6) They were told that photos were taken to them naked, and they were threatened that these photos will be sent to their families for humiliation.
7) They were also threatened that their wives and daughters will be brought and will be subjected to sexual harassment by the National Security officers.
8) In addition to beating and kicking all over the body while interrogating them for distraction.
These torture methods resulted to the following injuries:
- Mohammed Ismail Saad: he suffers from incontainment as a result of continuous electric shock in the genital organ. Saad also suffers from asthma which requires special medications to be in hand, and he was deprived from his medications. Saad suffered from a sever coughing and instead of giving him his medical spray, the officer sprayed it in air, while laughing and mocking, and Saad states that he tried to inhale as much as he can from the wasted spray in air.
- Mustafa Taher Al Ghounaimy: suffers from a broken arm, and sever dizziness due to continuous beating on the ear.
- Mahmud Zain Al Abedin: his right arm was broken.
- Khalid Ead Al Shimi: suffers from a broken rip.
EOHR lawyers witnessed some reckless procedures with the convicts including the following:
- The Prosecutor General refused to examine the injuries of Muhammed Ismail Saad
- The presence of National Security offices inside the Prosecutor General building, which is against the law.
EOHR places these information in the hands of the Prosecutor General and calls for an immediate investigation, and announcing the investigations results.
Accordingly, EOHR restates its persisting demands to reform the penal legislations against the crime of torture, and urging the Ministry of Interiors to take the required procedures to stop this blatant phenomenon. Previously, EOHR presented amendments to the Egyptian Penal Code to make the Egyptian legislatives compatible with the Convention Against Torture, which is signed by Egypt.
