EOHR's report on Alexandria misfortunes

On Sunday 6th November 2005, The Egyptian Organization for Human Rights (EOHR) issued a report entitled 'Alexandria Misfortunes … Causes and Defiance Strategy'. The report determines the causes and the procedures must be done to combat this sectarian misunderstanding, to prevent this chaos.

Moreover, the report also determines fact-finding mission's monitoring results of the misfortunes, and the complaints of the arrested' kindred.

The report describes the incidents' details concerning security forces' interference, the government and religious institutions negligence, in addition to the democratic vacuum.

Finally, EOHR calls the government to adopt democracy while dealing with these sensitive incidents, accordingly, EOHR demands fulfilling these procedures:
1) According to human rights provisions, the government must abolish religious attack as a respect for freedom of opinion and thought stipulated in article 151 of the Constitution and international human rights instruments which is guaranteed via the government's law.

2) Respecting the right to freedom of opinion and thought via releasing the demonstrators, this is considered their constitutional right, according to international human rights instruments; moreover, security apparatus have to deal with these misfortunes with much prudence to prevent repeating the same scenario again.

3) The Government must form a commission for religious issues in People's Assembly, gathering representatives in different fields; media, education, security, endowments and also representatives from churches, mosques and civil society organizations. The commission's goal is to solve all problems related to sectarian chaos between Muslims and Christians; it also must form religious institutions (churches or mosques) according to population and geographic distribution, via abolishing the law -issued in 1856- concerned with establishing Christian institutions in which any non-Muslim community has no right to form any religious institution without the Sultan's permission, this regime remained after the dismissal of (Aldawla Al- Othmania), and through out the time, the permission was taken according to the criteria of the age's authority (king or president).

On the other hand, the commission has to abolish ten restrictive administrative rules - since 1933 - related to churches' formation, and also the annulment of the presidential decree 13 [1998] issued in (11/1/1998), concerning the governors' power over churches' reformation, because of the decree's violation to article 40 of the Constitution, which avoid any discrimination related to sex, religion, or doctrine, it also violates article 46 which states citizens' freedom of opinion and thought , in which, it will not be fulfilled, unless the sectarian discrimination is abolished, via forming religious institutions without concentrating in their doctrine. The discriminative act is also revealed in the governor's interference in churches' reformation, in which it is the region's section responsibility, shedding light on the discriminative acts done against non-Muslim sects.

4) Muslim and Christian holy men have to enrich religious awareness and spread tolerance between all sects discarding their doctrine, and teach them how to respect all doctrines; they also must hold meetings to negotiate in their sectarian misunderstanding.

5) All religious institutions (mosques and churches) must deal with the sectarian misunderstanding with clear transparency and vigilance, via spreading it to the public to lessen the causalities; while on the contrary, both Al-Azhar and the Church adopt secrecy and fooled the public; The Mofti declared that the CD performance doesn't exist, while the Orthodox National Council in Alexandria in the statement (14/10/2005), declared the performance existence.
