EOHR Demands the Release of the Detainee Adbul Monaim Gamal Aldeen

EOHR expresses its deepest concern towards the deteriorating health conditions of the detainee Adbul Monaim Gamal Aldeen due to the mal treatment he suffers at Lyman Tora Prison. EOHR demands the release of Gamal AlDeen on medical reasons according to the Constitution and international human rights documents. EOHR also calls upon Counselor Abdel Magid Mahmoud, the Prosecutor General, to implement Article 42 of the Criminal Procedures Code and dispatch a representative of the Prosecution Office to investigate the situation inside Lyman Tora Prison and to determine Gamal Aldeen's health conditions to avoid endangering his life.
According to information received on the 24th January 2007, Gamal Aldeen is detained since 1993 despite of receiving an acquittal verdict from the Military Court in the Fatah Vanguard case. Gamal Aldeen also suffers from many health problems in kidneys, liver, blood pressure and spinal cord. In addition to the bad treatment he receives from the prison administration as they put him in a narrow corridor inside his cell inside the Prison's hospital in a position that forces him to sleep while squatting, despite of suffering from a slipped disc. According to the presented complaint, the Prison administration refuses to transfer him to Manial Academic Hospital to receive physical therapy.
In this context, EOHR reaffirms that the continuous detention constitutes a severe violation to the right to freedom and personal security, the right to stand before a normal judiciary and to challenge the legality of the continuous detention. This practice also deprive the detainees from exercising their right to implement the acquittal verdicts they received, which is a right furnished by the Constitution and the international human rights instruments.
Accordingly, EOHR demands the immediate release of all those who are detained with administrative decisions issued by the Ministry of Interior, especially those who already received acquittal verdicts from the Egyptian courts. EOHR also demands the release of all prisoners and detainees with medical conditions that require an exceptional release, and also to provide an integrated medical treatment inside prisons and detention centers.
