Police Corporal Sentenced to One Year of Imprisonment

On Wednesday 28th February 2007, Embaba Misdemeanors Court issued its decision on the case No. 4992/2007 in which the police officer Karim Abdullah Adbul Muhsen and the police corporal Ahmed Abdul Fattah Othman are charged of using violence against citizen Ehab Magdy Farouk. The Court Acquitted the police officer and sentenced the police corporal to one year of imprisonment.
The case started in 2005 when Ehab Magdy Farouk was arrested by two police corporals, Ahmed Abdul Fattah and Ahmed Ahmed Abdul Aziz. Farouk was detained inside a marble workshop at the Bohy Street where was subjected to beating, whipping and was thrown with pieces of marble which caused him wounds to the chin. Later on, Farouk was taken to Embaba Police Station where he was beaten by Ahmed Abdul Fattah on the back of his neck, while one of the police officers was filming using a mobile phone camera.
When Masry Al Youm Newspaper published all the details of this incident, Dokki Prosecution Office summoned the journalist who published this piece of news on 2nd February 2007 by a decree issued by the Prosecutor General. The Prosecution Office also summoned Farouk to hear his testimony. On the 3rd February 2007, the Prosecution Office summoned Farouk's father and wife to hear their testimony in the incident where they were illegally detained inside Mounira Police Station. EOHR dispatched its lawyers to attend the interrogations with the victim.
The Prosecution Office transferred the case to Embaba Misdemeanors Court where the officer Abdullah and the corporal Abdul Fattah faced the charge of using violence . on the 28th February 2007 the Court acquitted the police officer and sentenced the corporal to one year of imprisonment.
EOHR has adopted the case since its first start as a part of EOHR's campaign against torture. Its worth mentioning that EOHR presented a draft amendments of the Penal Code and the Criminal Procedures Code to the parliament to bring them in line with international human rights documents such case the Convention Against Torture which is ratified by Egypt in 1986 and became a part of Egypt's legislation according to Article 151 of the Egyptian Constitution.
