EOHR calls the President of parliament for reviewing the decision of depriving “Saad Aboud” to attend parliament sessions

The Egyptian Organization for Human Rights called Dr. “Fathi Sorour”, President of Parliament for running over the decision of depriving “Saad Aboud” , Independent member of parliament , to attend the sessions of the Council until the end of the current parliamentary period . This decision is considered a direct and flagrant violation of the provisions of the Egyptian Constitution, and a break down for the parliamentary oversight role guaranteed for members under the Constitution, and a threat for opposition and independents who practice their legitimate right of monitoring over the executive body.

This request came in a letter sent by the Egyptian Organization today, on Thursday, 14/2/2008 to the President of parliament , described the deprivation of "Saad Abboud" from attending the sessions of the Council until the end of the current parliamentary period as a "punishment" as he submitted an interrogation to the government accusing it of taking pilgrims funds unlawfully through the Committee that overseeing the mission of pilgrims lottery. As The parliament considered the action not conforming with the ideal parliamentary behavior and he was punished accordingly.

The Egyptian Organization confirmed that in the light of a number of constitutional provisions like "86, 98.125" ,the mentioned member didn’t commit a violation against executive body as he has a right to submit interrogations concerning theses issues as long as we are in the light of a democratic system controlled by the Constitution .So he was punished with a crime he didn’t commit. These articles can be described as follows :

In accordance with the provision of Article 86 of the Constitution ,

People's assembly assumes legislation authority and approves the general policy of the State .... and practice a control over the executive authority. Each member of people’s assembly - in accordance with the provision of Article 125 of the Constitution – has the right of submitting inquiries to the prime minister or his deputies, ministers or their deputies to set an account with them in matters that fall within their competences . Article 98 of the Constitution provides that "no blaming for members of People's assembly concerning their ideas and views stipulated in the Council or in its committees. "

The Egyptian Organization confirmed that there is a punishment over the member without any fault committed and this is considered a violation against the provisions of the Egyptian Constitution .Also Article 104 of the Constitution, which states that "The Council sets up its standing order to organize the working method and the way to practice its tasks, doesn’t give – from EOHR point of view –the council the right to issue this decision on the member who used his legal right .So, EOHR called people’s assembly for reviewing the decision issued in this respect .
